1. Subject
1.1. These General Terms and Conditions of Sale (hereinafter, General Conditions) govern the purchase of Products carried out remotely via electronic network through the website www.juveniis.it (hereinafter, the Website).
1.2. The owner of the website juveniis.it is Smart Plus di Meneghel Elvio, with registered office in Varedo – 20814 VAREDO (MB), registered with the Cagliari Business Register REA MB - 1859030, VAT number 03059820963.
2. Acceptance of the General Terms and Conditions of Sale
2.1. All purchases of Products made through the Website (hereinafter, the Purchase Contracts) by users accessing it (hereinafter, the Customers) are governed by these General Conditions as well as by the Italian Consumer Code (Legislative Decree no. 206/2005), Section II Distance Contracts (Articles 50–67) and by Italian regulations on electronic commerce (Legislative Decree 70/2003).
2.2. By concluding the Purchase Contracts according to the procedure, the Customer accepts and agrees to comply with these General Conditions.
2.3. The Customer is therefore required to carefully read these General Conditions before carrying out any purchase operation; they are made available by Juveniis also to allow reproduction and storage in compliance with Article 12, paragraph 3 of Legislative Decree 70/2003.
2.4. Juveniis may modify the content of the General Conditions at any time and without prior notice. The General Conditions published on the Website at the time the Customer submits the purchase order shall apply to each individual Purchase Contract.
3. Products
3.1. www.juveniis.it (hereinafter the “Website”) is an online store selling food products, cosmetics, beauty and personal care products, make-up and related accessories, natural remedies and household cleaning products (hereinafter, the “Products”).
3.2. All Products offered are described in detail on the Website within their respective sections, divided into product categories.
3.3. The visual representation of the Products on the Website, where available, is for illustrative purposes only and normally corresponds to photographic images of the Products; it is intended solely to present them for sale, without any guarantee or commitment by Juveniis regarding exact correspondence between the images shown and the actual Products, particularly with regard to their actual size and/or color aspects of the Products and/or packaging.
3.4. In the event of any discrepancy between the image shown on the Website and the actual product, the product description and specifications shall prevail.
4. Purchase Procedure
4.1. The Customer may purchase the Products listed in the Juveniis electronic catalogue, detailed on the Site within the respective sections by product category, as well as described in the relevant information sheets contained on the Site, following the technical access procedures indicated therein.
4.2. To purchase the Products, the Customer may either register on the Site or proceed as a Guest; in any case, they must enter their personal details in accordance with the instructions provided in the registration and payment process, which require completion and confirmation of submission by clicking the acceptance button. Orders must be fully and accurately completed. If the Customer chooses not to register on the Site, they may still complete the purchase, but will not be able to track the status of their orders or take advantage of discounts and promotions, although they will always be able to track the delivery of their order.
4.3. The Customer must add the selected Products to the “Cart” and, after selecting the courier and reviewing and accepting the contribution to delivery charges, may proceed with the purchase.
4.4. Should the Customer need to modify the purchase order or amend any details contained therein, they must follow the modification procedure available on the Site. Specifically, the Customer may adjust the quantity of Products they wish to purchase, adding or removing one or more Products from the Cart.
4.5. Upon completing this operation, the Customer will be presented with a screen displaying the order summary, including delivery charges, with a request for further confirmation to proceed with the purchase.
4.6. After viewing the summary, the Customer must select their preferred payment method, namely cash on delivery, credit card, PayPal, or – if available – via JUVENIIS-GIFT-Card, and submit the order by clicking the appropriate button.
5. Conclusion of the Contract
5.1. The publication of the Products on the Site constitutes an invitation for the Customer to make a contractual purchase offer. The order submitted by the Customer shall be considered a contractual proposal and implies full knowledge and complete acceptance of these Terms of Sale.
5.2. Each Purchase Contract concluded between Juveniis and the Customer is considered concluded upon Juveniis sending acceptance of the order to the Customer’s email address. This confirmation message will indicate an "Order Number," to be used in any subsequent communication with Juveniis. The message will also reiterate, in addition to legally required information, all data provided by the Customer, who undertakes to verify their correctness and promptly communicate any corrections. Any additional costs resulting from errors in the data not promptly reported by the Customer shall be borne exclusively by the Customer.
5.3. Each order can be viewed by the Customer on the Site, in their personal area, if registered, or by contacting Juveniis Customer Service immediately after submitting the order.
5.4. Occasional unavailability of the offered Products may occur. In such cases, if the Products selected by the Customer are partially or entirely unavailable, the Customer will be contacted by Customer Service to manage the exception. The Customer may cancel the entire order or cancel only the purchase of unavailable Products; in the case of a full cancellation, the amount paid will be refunded, and in the case of a partial cancellation, the Customer may choose either a refund of the relevant sums or a voucher equal to the amount of the unavailable Products, usable for a subsequent purchase.
5.5. Juveniis reserves the right, at its sole discretion, to accept or reject the order submitted by the Customer, without the Customer being able to claim any rights or compensation in case of non-acceptance of the order.
5.6. In particular, Juveniis reserves the right not to accept purchase proposals and to cancel orders that do not provide sufficient guarantees of solvency or where anomalies are detected in transactions or payment methods used by the Customer, including after verification with the credit card payment system.
5.7. The Customer can verify at any time the content of the concluded purchase contracts by accessing their personal area on the Site, if registered, or by contacting Juveniis Customer Service. This data will be available for a period of 12 months from the delivery of the Products.
6. Product Prices
All Product prices are clearly indicated on the Site and are inclusive of VAT. Delivery charges are clearly highlighted at the time of ordering. The cost of each shipment may vary depending on the delivery and payment method, as well as the destination and the total amount of the order.
7. Invoicing and Payment Methods
7.1. Juveniis issues a receipt for the purchased Products at the moment they are handed over to the courier for shipment, sending it via email to the Customer and attaching it to the shipped package. The information provided by the Customer is considered accurate for issuing the receipt. No changes to the data will be possible after the invoice has been issued.
7.2. Juveniis issues an invoice exclusively for amounts over 50 euros and upon explicit request from the Customer, which must be made at the time of ordering or on the same day; requests for invoicing received after the order day cannot be processed.
7.3. As detailed below, payments by Credit Card and PayPal only require an authorization or a reservation of funds, with the actual charge occurring when the Customer’s order is confirmed. At this stage, Smart Plus will also issue the receipt or invoice, if requested, for the order.
7.4. Payment for purchased Products can be made by credit card, PayPal, cash on delivery, or – if available – the SMARTPLUS Gift Card according to the methods specified below:
- Online Credit Cards – Accepted credit cards are: Visa, Mastercard, American Express. All data is transferred encrypted via SSL certificate and is therefore not interceptable by third parties. Data entry occurs directly on the bank’s website, ensuring maximum security. The order amount is not immediately charged to the card, but in a subsequent phase, within the limits authorized by the Customer. At the time of order submission on the Juveniis site by Smart Plus, only an authorization of the payment for the indicated amount is requested (often at this moment an SMS/email is sent to the Customer by the issuing bank). Authorization does not imply a charge but simply reserves the corresponding amount; the charge is actually processed when Juveniis confirms the order.
- PayPal – PayPal, an eBay group company, is a fast and secure payment system. Once the order is completed and PayPal is chosen as the payment method, the buyer will be redirected to the PayPal site, where they can access their account by entering their personal email address and password. After registration, payments via PayPal can be made without re-entering data, also for subsequent purchases. Choosing PayPal, the amount is charged directly to the assigned credit card (Visa, Visa Electron, Mastercard, American Express) or prepaid card (PostePay). PayPal protects the buyer’s information, as financial information is not passed. A confirmation email is sent for each transaction. The order amount is charged to the PayPal account at the time of order confirmation. At the time of order entry on the website, only an authorization request is made to check the Customer’s PayPal balance, without any charge. In case of order cancellation, the amount is refunded to the Customer’s PayPal account.
- Cash on Delivery – The Customer can pay directly to the courier delivering the ordered Products. Only cash is accepted for this payment method. The courier will not accept bank checks or cashier’s checks and will not deliver the Products unless the exact amount indicated in the order is received. The courier is not authorized to give change. This payment method may incur additional costs depending on the quantity of goods and the available courier, but it will never exceed €100.00.
9. Discount Vouchers – Promotions
9.1. Any discount vouchers or promotional codes can be applied at the time of placing the Customer's order. The system will update the total order amount net of the voucher value.
9.2. The discount voucher may be combined with other commercial initiatives only if expressly indicated.
10. Right of Withdrawal and Its Effects
10.1. The Customer has the right to withdraw from the contract, without giving any reason, within 14 days (withdrawal period).
10.2. The withdrawal period expires (i) 14 days after the day on which the Customer or a third party, other than the carrier and persons designated by them, acquires physical possession of the goods, or (ii) in the case of a contract relating to multiple goods ordered in a single order and delivered separately, from the day on which the Customer or a third party, other than the carrier and persons designated by them, acquires physical possession of the last good.
10.3. To exercise the right of withdrawal, the Customer must inform Juveniis of their decision to withdraw from the contract via an explicit statement (e.g., letter sent by post, fax, or email); a sample document is available for download.
10.4. To meet the withdrawal deadline, it is sufficient for the Customer to send the communication concerning the exercise of the right of withdrawal before the withdrawal period expires.
10.5. The seller will refund the full amount paid, including, where applicable, the original shipping costs, within 14 days from the date of receipt of the withdrawal notice; the refund may be delayed beyond 14 days only until the consumer provides proof of having returned the goods or until the goods are received by the seller. The only costs borne by the consumer are those for returning the goods.
10.6. The Customer must return the goods or deliver them to Juveniis without undue delay and in any case within 14 days from the day on which they communicated their withdrawal from this contract. The deadline is met if the Customer sends back the goods before the 14-day period expires. The direct costs of returning the goods will be borne by the Customer. The Customer is only responsible for any diminished value of the goods resulting from handling the goods other than what is necessary to establish the nature, characteristics, and functioning of the goods.
10.7. The Customer cannot exercise the right of withdrawal in the case of sealed goods which are not suitable for return for reasons of hygiene or related to health protection and have been opened after delivery.
11. Non-Conformity and Defective Products
11.1. The Products offered on the Site comply with national and EU legislation. Images and colors of the Products displayed on the Site may differ from the actual ones due to local system settings and/or the devices used for viewing.
11.2. In case of non-conformity of the purchased Products with the description published on the Site, or in case of faulty or defective Products, the Customer is entitled to an immediate refund of the non-conforming item, upon sending photographs via the form in the Customer Service section that clearly show the damage or non-conformity of the Product.
11.3. Juveniis staff will then communicate the refund method, which, at the Customer's discretion, may also be carried out via discount vouchers for the next purchase exceeding the value of the item to be refunded, without any further liability on the part of Juveniis.
11.4. In any case, the provisions regarding the legal guarantee of conformity of goods, as provided by the Italian Consumer Code (Legislative Decree 206/2005, Part IV, Articles 102-135), remain valid.
12. Personal Data Processing
Customer data are processed by Juveniis in accordance with applicable data protection laws, as specified in the dedicated section called "Privacy Policy".
13. Communications and Complaints
All communications or complaints from the Customer regarding Purchase Contracts must be sent through the appropriate contact tools available on the Site.
14. Intellectual Property Rights
All trademarks (registered or not), as well as any work of the mind, distinctive signs or names, images, photographs, written or graphic text, and, more generally, any other intangible property protected by international intellectual and industrial property laws and conventions, reproduced on the Site, remain the exclusive property of Smart Plus and/or its licensors. Access to the Site and/or the conclusion of Purchase Contracts does not grant the Customer any rights thereto. Any use, even partial, of these is prohibited without the prior written authorization of Juveniis, which retains all related rights exclusively.
15. Applicable Law and Competent Court
15.1 These General Terms and Conditions and any contract concluded with the Customer are governed by Italian law, without prejudice to the application of EU legislation and international treaties, where applicable, as well as national consumer protection laws.
15.2 In the event of disputes with consumers, pursuant to Art. 66-bis of Legislative Decree 206/2005 (Consumer Code), territorial jurisdiction is non-derogably assigned to the court of residence (or domicile) of the consumer.
15.3 Furthermore, a consumer established in Europe can use the platform provided by the European Commission for the resolution of any disputes arising from an online contract concluded on the Site. The European ODR platform is available at the following link: https://webgate.ec.europa.eu/odr
